The client must read and agree to these terms of service. By purchasing a commission, you are indicating that you agree to the terms stated below.

PAYMENT:
- All payment is taken up front. The only exception is full background pieces which are over $500, in which case a payment plan can be established; but I will not fully finish, scan or ship the artwork until all payments have been received.
- Payment is expected within a week of getting a commission slot. Unless a different timing was agreed upon, failure to pay by the deadline may result in your slot being given to someone else.
- Paypal is my preferred mode of payment, although if this really isn't possible for whatever reason, I am willing to accept postal money orders.
TIMING:
- Commissions usually take less than 2 months from payment date to be completed, but this of course depends on how fast communication is on the client's side. In the event that an injury or something else out of my control happens preventing me from working on the art, it may take longer.
- A commission is considered "abandoned" when it takes the client more than three months (90 days) to reply to my last attempt at contacting them about their commission. I will no longer continue working on or fully refund an abandoned commission once the three months have passed, even if the client suddenly starts replying again. A partial refund can be issued in accordance with the amount of work already put into the piece.
- I am willing to work under any reasonable deadlines, but the deadline date must be set and agreed upon before I accept payment. I will not try to meet any deadlines that weren't previously set, and will refund the client if this is unsatisfactory only if work hasn't already been started.
REFUNDS:
- Full refunds will only be issued in cases where the work has not already been started. If work has been started, partial refunds are possible, and they will be issued in accordance to which stage of completion the artwork is in at the time of the refund request. For example, if only the sketch is completed, then I will refund the initial commission cost minus what I normally charge for sketches.
PROCESS AND EDITS:
- Once payment has been received, the client will be officially put on my list and will receive a sketch for approval. I do not necessarily work in order of payments received, but I stay mindful of how long people have waited.
- Once the client receives the rough sketch, edits may be requested at no extra charge, but only up to two times. After the initial two edits, charges of $15 for each edit will be added. If something was clearly mentioned in a description or appeared on a reference sheet and I made a mistake, I won't count it against you.
- If the client wants a complete redraw of the initial sketch (or a large enough part that it's almost like redoing the entire sketch), I will do it at no extra charge one time, but I reserve the right to keep the rejected sketch, modify it and sell it off. If more than one entire redraw is needed, my regular sketch prices will be charged for each new sketch.
- After a sketch has been approved I will no longer accept alterations, and I will go on to finishing the artwork. Slight tweaks to colors may still be asked for at that point in time, but the possibility of such depends on the medium I'm working in. Ultimately, the client is responsible for the accuracy and clarity of their references and descriptions, as there is very little I can do when it comes to modifying traditional art.
SHIPPING:
- Once the artwork is completed, the client will choose their preferred shipping option (insurance, speed, tracking, etc.) and pay for shipping (applies to all types of commissions except for badges and fully digital art). For digital artwork, the client will get the full size file of the finished art.
- All art gets shipped sandwiched between pieces of box board and protected in plastic, but I can ship it matted for extra (cost depends on mat size), which makes it safer in transit and ready to frame and hang.
- If for any reason the client does not ask/want to have an original shipped to them I retain the right to sell it, as I cannot indefinitely keep pieces in storage.
RIGHTS/COMMERCIAL USE:
- The client retains all rights to their characters. They can upload the web version of the artwork provided by me online as they wish (this is the same version I post in my galleries), and use it online in any non-commercial manner. They may edit the work to use as icons, banners, and other such non commercial uses. Credit or a link back to me is appreciated but not necessary if my copyright info remains visible on the full image.
- In the case of digital art, the client is allowed to print up a print for themselves if they wish to display the artwork, and the print file will be provided for this use. The client is not allowed to print further prints to give away or share the print file, printing use must strictly remain personal and non-commercial, which also applies to traditional art.
- I retain all commercial rights to the artwork, unless previously agreed upon BEFORE the start of the commission (time of payment). Commercial rights can be negotiated for an extra cost depending on the use intended and the subject matter, and the cost would be determined on a case by case basis.
- My retaining commercial rights means I can upload the artwork online, sell prints, merchandise or use the artwork in any other commercial or promotional manner, without claiming ownership of the characters depicted.
- Under no circumstances can the commissioned artwork be used to mint NFTs or otherwise be used in association with cryptocurrency.
CONTENT RESTRICTIONS:
- I reserve the right to decline any commission request for any reason. But a list of subject matter I definitely won't draw follows:
- Violent rape, underage looking characters in sexual situations.
- Bodily excretions besides sperm, spit and tears.
- Human beings in a fully realistic style, unless I am reproducing a photo. I can pull off something in a comic/graphic novel sort of style though.
- Certain copyrighted characters (copyrighted species are OK).
- Other people’s characters unless I get an e-mail from their owner saying it’s alright for me to do so (if it’s a surprise gift for a friend, we can discuss it, it shouldn’t be a problem).
